Welcome to Samurai For Sale (“we,” “us,” or “the Platform”) Auctions. By bidding using Samurai For Sale (“Samurai For Sale,” “SFS,” “we,” “us,” or “the Platform”), you agree to the following Auction Terms of Service.

1. Marketplace Role

Samurai For Sale operates an online auction marketplace for Suzuki Samurai vehicles, parts, and related items.

Samurai For Sale does not own, inspect, possess, title, store, or transport listed items. Listings are provided by sellers, and transactions occur directly between buyers and sellers via SecurePay.

2. Eligibility & Accounts

You must be at least 18 years old, provide accurate and current information, and maintain the security of your account credentials. You are solely responsible for all activity conducted through your account.

Samurai For Sale may suspend or terminate accounts at its sole discretion.

3. Binding Bids & Payment Obligations

All bids placed on Samurai For Sale are legally binding offers.

If you are the winning bidder, you agree to:

• Complete the transaction
• Pay the final bid amount through SecurePay
• Promptly initiate payment following auction close, unless otherwise specified by the seller

Bid retractions are not permitted. Failure to promptly initiate payment may result in forfeiture of a $99 bidder authorization deposit, account suspension, permanent ban, and reporting to relevant payment processors or authorities.

4. Auction Mechanics

Listings may include reserve prices or Buy Now options. Auctions end at the stated time unless extended due to last-minute bidding, technical issues, suspected fraud, or policy violations.

Samurai For Sale reserves the right to cancel, suspend, modify, or restart auctions at its sole discretion.

5. Fees

Samurai For Sale may charge:

• Seller fees
• Payment processing fees
• Bidder authorization deposits (typically refundable unless forfeited)

All fees are disclosed prior to participation and are non-refundable unless required by law.

6. Payment, Transfer & Logistics

Buyers and sellers are responsible for:

• Completing transactions through SecurePay
• Compliance with all applicable laws and regulations
• Title transfer, registration, taxes, and insurance
• Shipping or pickup arrangements, which may be optionally facilitated through SecurePay vendors

Samurai For Sale is not responsible for delays, failures, or disputes related to delivery.

7. Listings, Verification & Due Diligence

Listings are created by sellers. While Samurai For Sale may undertake material steps to verify sellers and listings, Samurai For Sale does not guarantee accuracy or completeness.

Photos, descriptions, and statements are not warranties. Mileage, condition, originality, and modifications are seller-reported. Buyers are solely responsible for conducting their own due diligence prior to bidding.

8. As-Is Sales

Unless explicitly stated otherwise in writing, all items are sold as-is, where-is, with no warranties of any kind, express or implied, including warranties of fitness, roadworthiness, merchantability, or legality.

9. Prohibited Conduct & Enforcement

Users may not:

• Place fraudulent, shill, or self-bids
• Manipulate auctions or pricing
• Misrepresent identity or intent
• Use bots, scripts, or automated bidding tools
• Harass or threaten other users
• Circumvent Platform rules or enforcement mechanisms

Violations may result in immediate suspension, permanent ban from all Samurai For Sale platforms, forfeiture of deposits, cancellation of transactions, and reporting to payment processors, financial institutions, or law enforcement.

10. Circumvention & Off-Platform Transactions

Any attempt to circumvent Samurai For Sale auctions—including initiating or completing private sales with sellers outside the Platform for listed or recently listed items—is strictly prohibited.

Users engaging in such conduct will be permanently banned from all Samurai For Sale platforms and may be reported to relevant authorities and third parties.

11. Disputes

Disputes must be resolved directly between buyers and sellers. Samurai For Sale may, but is not obligated to, assist, facilitate communication, or take enforcement action. Samurai For Sale does not guarantee dispute resolution outcomes.

12. Disclaimer of Warranties

The Platform is provided on an “as-is” and “as-available” basis. Samurai For Sale disclaims all warranties, express or implied, to the maximum extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, Samurai For Sale shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability is limited to fees paid to Samurai For Sale related to the applicable transaction.

14. Indemnification

You agree to indemnify and hold harmless Samurai For Sale from any claims, losses, damages, liabilities, or expenses arising from your use of the Platform, bids, transactions, or violation of these terms or applicable law.

15. Modifications & Termination

Samurai For Sale may update these terms or discontinue the Platform at any time. Continued use constitutes acceptance of updated terms.

16. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue shall lie exclusively in courts located within that state.
